APPLICABLE LAW

The second section of article 22 of Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (hereinafter, LSSI-CE), establishes the following:

Service providers may use data storage and retrieval devices in their recipients’ terminal equipment, provided that these have granted their consent having been provided with clear and complete information on their use, in particular, on the purposes of data processing, in accordance with the provisions of Organic Law 15/1999 of 13 December on the Protection of Personal Data.

When technically possible and effective, the recipient’s consent to accept the processing of the data may be facilitated using appropriate parameters of the browser or other applications, provided that this configuration takes place during installation or update by means of an action specific to that effect.

This shall not prevent any possible storage of or access to data for the sole purpose of carrying out or technically facilitating the transmission of a communication over an electronic communications network, or as strictly necessary in order to provide an information society service explicitly requested by the recipient.

According to the “Guide on the use of cookies” published by the Spanish Agency for the Protection of Data (Asociación Española de Protección de Datos hereinafter AEPD) in 2013, the LSSI-CE  is applicable to any type of file or device that is downloaded in the terminal equipment of a user for the purpose of storing data that can be updated and retrieved by the entity responsible for its installation. The cookie is one of those devices of general use so, henceforth, we will refer to these devices generically as cookies.

Cookies used for any of the following purposes are exempted from compliance with the obligations established in article 22.2 of the LSSI-CE:

To permit communication between the user’s computer and the network.

To strictly provide a service explicitly requested by the user.

  1. TYPES OF COOKIES ACCORDING TO THEIR PURPOSE.

A cookie is a file that is downloaded to your computer when you access certain web pages. Cookies allow a website, among other things, to store and retrieve information about the browsing habits of a user or his or her computer and, depending on the information they contain and how the equipment is used, can be employed to recognize to user.

As stated in the “Guide on the use of cookies” of the AEPD, according to the purpose for which the data obtained through cookies are processed, we can distinguish between:

Technical Cookies: These are the ones that allow the user to browse through a website page, a platform or an application and use the different options or services it contains, for example those of controlling traffic and data communication, identifying the session,  accessing restricted areas, remembering the features that make up an order form, carrying out the purchase of an order, applying to sign in or take part in an event, using security features while browsing, and storing content for the  broadcasting of videos or sound or sharing content through social networks.

Personalization cookies: These are the ones that allow the user to access the service with certain predefined general characteristics based on a series of criteria in the user’s terminal such as language, the type of browser used to access the service, the regional settings from where the service is accessed, etc..

Analysis Cookies: These are the ones that allow monitoring and analysis of the behavior of the users on the websites to which they are linked. The information collected through this type of cookies is used to measure the activity on a website, an application or a platform and to elaborate navigation profiles of the users of these sites, applications and platforms, in order to make improvements based on the analysis of the usage data of the users of the service.

Advertising Cookies: These are the ones that allow the most efficient possible management of the advertising spaces which, the publisher may have included in a web page, an application or a platform from which the requested service is provided based on criteria such as edited content or the frequency at which the ads are displayed.

Behavioral advertising cookies: These are the ones that allow the most efficient possible management of the advertising spaces that the publisher may have included in a web page, an application or a platform from which the requested service is provided. These cookies store information on the user’s behavior obtained through the continuous observation of browsing habits, which enables the creation of a specific profile on which to base the displaying of advertising.
